[56th Thread : Gender Equality in Islam]
The subject of gender equality doesn't mean 'sameness' as men & women can't be same given our anatomy, physiology and psychology etc.
Here, gender equality means in ontological sense based on the principle of equity and justice.
1/
That is a man isn't superior to woman bcz of his gender and both genders should be treated in dignity equally as Islam doesn't accept gender bias.
The superiority of any gender is based on deeds and ethics.
As the verses in Qur'an mention,
75:39 says God created the human
2/
and made them into males & females.
17:70 says
“We
have bestowed dignity/nobility on the progeny of Adam...
Progeny consists of both men & women with gender bias.
Interestingly the verse says كرمنا
The word كرّم here is ontological so the essence of nobility remains same
3/
for both males & females.
That is a man can't be more superior in dignity than a woman as they both constitute progeny.
33:35 explicitly mentions both men and women without any bias for reward & forgiveness given by God.
This verse should be understood in the context of
4/
Patriarchal society of Arabs back then who had treated their women as little less than property
devoid of any rights,Inheritance, or even the allowance to engage in
civic duties. But in above verse, they're at par with men too in deeds as well as rewards.
In terms of moral
5/
practices, 16:97 says there is no impartiality towards any gender.
In term of employment, 3:195 explicitly mentions that there is no gender bias or a man is preferred or superior to a woman.
The words, عامل منكم من ذكرٍ أو أنثىٰ
is a clear evidence for equality of gender
6/
based on equity & justice.
In term of civic duty, 9:71 talks that both men & women are equally responsible for their civic obligations.
[The verse deals with the duties of that time & isn't that restricted to mentioned instances of civic obligations]
In term of education,
7/
The Hadith is very clear that it's obligatory to seek on both men & women without any bias.
The history tells us how companions of the Holy Prophet would go to Aisha for seeking knowledge(1st image).
This also negates the fact a man can't seek knowledge from a woman or
8/
the roles are specified to genders.
There is this fantastic PhD thesis in Arabic on Gender Studies surrounding the Arab & Islamic world titled ظاهرة الاختلاف في الثقافة العربية الإسلامية by Dr. Amaal Qarami, based in Tunisia in which she discussed every kind of differences
9/
raised based on gender differences.
The 998 pages comprehensive research!
Conclusion?
She concluded that 99% of differences between men & women don't occur as a rssult of distinction in creation, natural inclinations, physicality, psychological factors etc but based on
10/
"Cultural and Social differences in understanding".
That is to say, she is nurtured in this a particular way so she is this or that or if she was nurtured in a different way then she'd come out in a different way.
Also, the roles are determined by society.
So if a woman
11/
is nurtured in a similar way as a man, could she take on those roles specified to only men, is an interesting question.
Not to forget that some women are already breaking the stereotypes across the globe.
What is Superiority based on in Islam?
If there is no superiority
12/
based on gender then what determines it?
The answer to this question is in 49:13,
The verse is very explicit that men and women are equal ontologically & then there is no superiority of gender, race, ethnicity, tribe, nation etc except by piety which implicitly means
13/
deeds and ethics...
A lot of notions and aspects I'm leaving since they go beyond the scope of this thread.
Objections:---
2 objections I wanna discuss.
1. Men are superior to women based on these verses[2:228 & 4:34]
Comment:-
a. The parts
وللرجال عليهن درجة
(2:228)
14/
And the men have a degree over them) or بما فضل الله بعضهم على بعض
(Because Allah has made some of them to excel others)
The words درجة and فضل, are they ontological, legislative, social, physical, intellectual etc??
If they're ontological then it contradicts the above
15/
verses.
The physical & intellectual completely depends on nurturing & genetics.
Surely, men possess high level of testosterone due to which they can have more muscle mass & so their aggression is quite physical.
But this is absolutely true for all men hence can't be
16/
determining factor for superiority.
Similarly, the intellectual capacity isn't true for all men.
The only plausible explanation for this درجة seems 'social' due to a particular setting of the society & back then it's patriarchal.
b. In the verse, 4:34 it talks about men
17/
being providers for women, both proven through cultural anthropology & history, درجة seems to be socio-cultural issue as men used to have guardianship over women.
c. In verse 2:228, وللرجال عليهن درجة the degree is in context of responsibility/obligations & not privilege.
18/
2. Men do polygamy, take double shares in inheritance etc...
This view that men can do polygamy isn't some privilege amounting to superiority.
In this thread, I discussed Polygamy & a plausible view is it's not even Sunnah & has strict conditions.
19/
The double shares in inheritance comes with the responsibility of taking care of wife, kids, parents, siblings(conditional) & other monetary expenses.
While the share of a woman remains as hers exclusively.
For Testimony, It's responsiblity in itself & judging from the
20/
society where the transactions, debt etc were male dominated; it makes sense else in contemporary time, a woman being CA can understand these issues far better.
One can also apply قاعدة العدل(principle of justice) to base it.
END!!
To be continued..{on marital rape/forced sex}
A thread on Gender Equality in Islam.
Hopefully we can end this debate.
Give it a read & share :)
