Some tidbits with interesting implications for AI/ML software from the EU's proposed AI Act (digital-strategy.ec.europa.eu):
> 'training data' means data used for training an AI system through fitting its learnable parameters, including the weights of a neural network (Article 3)
Does this mean the learned model parameters are part of the training data??
Article 5, section 1c. Does this mean "AI fairness" won't be enforced for private corporations?
> A risk management system shall be established, implemented, documented and maintained in relation to high-risk AI systems. (Article 9)
New AI compliance startups that do risk management as a service for your software?
> Testing shall be made against preliminarily defined metrics and probabilistic thresholds that are appropriate to the intended purpose of the high-risk AI system. (Article 9)
At my previous co, thresholds changed over time as the model + data changed. This won't be easy
Article 10. If the definition of training data includes model params, models themselves need to be audited
> The logging capabilities shall ensure a level of traceability of the AI system’s functioning throughout its lifecycle that is appropriate to the intended purpose of the system. (Article 12)
Love that the logging & tracing stuff I'm working on could be in the right direction
> High-risk AI systems shall be accompanied by instructions for use in an appropriate digital format or otherwise that include concise, complete, correct and clear information that is relevant, accessible and comprehensible to users. (Article 13)
MoDeL cArDs As A sErViCe
Thrilled that they used the right definition of adversarial examples (Article 15)
Cool that deepfakes are required to disclose fakeness, but looks like they think law enforcement agencies should totally be exempt from transparency obligations (Article 52)
Full disclosure I know nothing about law and policy but I do know companies need to follow the law and pay lots of $$ to be compliant so πŸ€·β€β™€οΈ
