Marriage of minors
“These days another fitnah is afoot, this attempt is being made that the law of guardianship that the Islamic Sharīáh has issued and has given guardians the permission and choice to perform the marriage of minor males and minor females,
that it be nullified and such an effort be made that this right of the guardians in the Sharīáh be declared a crime in the law of the government current time and in such a manner, the laws of the Muĥammadan faith be abolished.
A person be not able to perform the marriage of his minor children, and if he does so according to the permission of the Sharīáh then they be declared criminals, be punished, be struck by affliction,
boys and girls marry according to their own choice after becoming pubescent [bāligh], and that Muslims be stuck in the humiliation of a shameful life.
A respected individual is lying ill on his deathbed, before him are his daughters, the light of his eyes, for whom he sees no protector after himself. More than his illness, this worry is making him restless, that after him how shall his honour be protected?
In this state, for the sake of his peace, he plans that he marries his beloved daughters to the promising sons of a respected family. By doing so, he becomes content that the family in which he has married his daughters, they shall take care of of them,
in consideration of protecting their honour, and the daughters shall be protected from the humiliating life of helplessness and dangers.
The proposal to make marriage of minors a crime shall compel a man at the time of death to take with him an agonising stain on his heart of his disgrace and dangers to his honour.
This was one example, if you pay heed then there are many benefits in marriages of minors, and by making it a crime the life, wealth, and honour of Muslims all fall into danger, and worse than all of these what a calamity is this, that the law of the pure Sharīáh is abolished.
The Muslims, true Muslims, can accept death but cannot accept such a law.”

In this extract we see that Şadru’l Afāđil objected to and criticised the proposal to ban the marriages of minors that took place in the early 20th century. Though the marriages of minors is not an obligation in Islamic law, it is a permission with many benefits and wisdoms.
We observe the opposition displayed by Şadru’l Afāđil and that he did not support such a law which contradicted and opposed the law of the Sharīáh, and he dictates unto us what our attitude should be towards such proposals which seek to abolish the law of the Muĥammadan Sharīáh.
