The major Shirk of obedience, التشريع
We will first begin with the definition of تشريع
المنع والإذن على وجه العموم مع سلطة آذن والمانع
Forbidding and permitting in a general manner that is with authority to permit and forbid
Tashree’ comes under the issue of Tahleel and Tahreem which is to make something halal or haram.
There are numerous verses in the Quran related to this matter.
At-Taubah 9:31
اتخذوا أحبارهم ورهبانهم أربابا من دون الله والمسيح ابن مريم وما أمروا إلا ليعبدوا إلها واحدا ۖ لا إله إلا هو ۚ سبحانه عما يشركون
They have taken their scholars and monks as lords besides Allah, and [also] the Messiah, the son of Mary. And they were not commanded except to worship one God; there is no deity except Him. Exalted is He above whatever they associate with Him.
At-Taubah 9:32
يريدون أن يطفئوا نور الله بأفواههم ويأبى الله إلا أن يتم نوره ولو كره الكافرون
They want to extinguish the light of Allah with their mouths, but Allah refuses except to perfect His light, although the disbelievers dislike it.
Thes above verses of Surah Taubah have the same meaning as the verse in Surah Imaran 64
قل يا أهل الكتاب تعالوا إلى كلمة سواء بيننا وبينكم ألا نعبد إلا الله ولا نشرك به شيئا ولا يتخذ بعضنا بعضا أربابا من دون الله
Say, "O People of the Scripture, come to a word that is equitable between us and you - that we will not worship except Allah and not associate anything with Him and not take one another as lords instead of Allah,
The above verses are the foundation for what is Shirk of Obedience in the issue of Tahleel and Tahreem that is Tashree’ and clearly show it is an issue of shirk.
Aal-e-Imran 3:79
ما كان لبشر أن يؤتيه الله الكتاب والحكم والنبوة ثم يقول للناس كونوا عبادا لي من دون الله ولكن كونوا ربانيين بما كنتم تعلمون الكتاب وبما كنتم تدرسون
It is not for a human [prophet] that Allah should give him the Scripture and authority and prophethood and then he would say to the people, "Be servants to me rather than Allah," but [instead, he would say],
"Be pious scholars of the Lord because of what you have taught of the Scripture and because of what you have studied."
Aal-e-Imran 3:80
ولا يأمركم أن تتخذوا الملائكة والنبيين أربابا ۗ أيأمركم بالكفر بعد إذ أنتم مسلمون
Nor could he order you to take the angels and prophets as lords. Would he order you to disbelief after you had been Muslim’s?
So we understand from these verses that it is a matter of Shirk and is clear disbelief.
A person can be worshipping other Allah not knowing that they’re.
This is evidenced and explained in the Hadith of Adiy Ibn Hatim which makes clear in detail how this occurs.
The great Sahabi Adiy Ibn Hatim used to be a Christian and he had once come to the Prophet and heard the Prophet recite the verse in Surah Taubah
Adiy then replied to prophet saying
“we did not worship them”
The Prophet then said to Adiy
“Did they not forbid for you what is permitted and you forbade it, and they permitted what is forbidden and your permitted it?”
Adiy then responded in the affirmative and the Prophet said
“so this is their worship”
As explained by the Prophet, about the verse and related ones, that making something halal or haram is from the rights of Allah and for someone to come and change these commands of Allah is disbelief and those who then intentionally take it from them have fallen into Shirk Akbar.
The Hadith also tells us that they did not believe they were worshipping other than Allah as was mentioned by Adiy.
In another Hadith of Adiy the Prophet gives an example of how they would take what is haram as halal from their priests and Rabbis whilst knowing it was haram.
The Prophet commanded Adiy to become a Muslim
Adiy responded to the Prophet saying he already has a religion, to which to Prophet replied that he knows his religion better than him.
The prophet said “were you not from the leaders of your tribe?” Adiy confirms this
The Prophet then says “did you not take for yourself a 4th from the war booty?” Adiy then confirms this.
The Prophet then says to Adiy “this was not permitted for you in your religion”
This shows Adiy as a Christian knew that this was was forbidden in his religion but still accepted it as it was made halal for him by his priests.
This is shirk in Ruboobiyyah,they didn’t pray, do sujood, believe them to be gods etc yet made them worshippers of other than Allah
In summary:
1. The issue of Tashree is kufr and is from Shirk in Obedience.
2. This Shirk occurs when Halal and haram is taken from other than Allah whilst knowing it goes against his commands as explained by the Prophet.
3. They did not believe they were worshipping other than Allah
4. istihlal occurred in their action whilst they believed it to be wrong.
The Sahaba had commented on the verse of surah Tawbah on how this was Shirk of Ruboobiyah
It was narrated from Hudayfah he said “They did not worship them, but they made what is permissible into forbidden and what is forbidden into permissible and they followed them in that.”
Abu Al-Bakhtari said
“If they (the Rabbis & priests) had commanded them to worship them instead of Allah they would not have obeyed, but they made what is permissible into forbidden and what is forbidden into permissible so they followed them, and this was their Ruboobiyah”
Shaykh Al Islam Ibn Taymiyyah said
“whoever follows them [scholars who have done Ijtihad] with the knowledge that they’re wrong and have contradicted the Prophet, indeed he has worshipped other than Allah and committed Shirk.”
