Recently, Wipro fired 300 employees for moonlighting. Infosys had sent warning emails. TCS and IBM have termed it unethical.
Tech giants are against it. But employees are not happy. How illegal is it? ๐Ÿงต
What is moonlighting?
- Apart from your one full-time job, if you are working for someone else secretly, mostly at night.

Why are companies against it?
- When you join a company, you sign a contract that states you'll be working exclusively for them.
- In return, they'll give you a salary (wage), cover your and your family's health insurance, give you gratuity, etc.

Why are (many) employees in favor of it?
- Employees feel companies don't hike their salaries as expected.
- Employees also feel they are not slaves. Apart from working hours, whatever they do, it's none of other's business.

How do companies suspect?
- Your colleagues and managers in companies may have observed some changes in you financially and performance-wise.
- Employees have also made blunders by doing two or more full-time jobs at the same time.

So? Is moonlighting illegal?
- In most countries and jurisdictions, there is no law prohibiting moonlighting. So, it's not entirely illegal.
- Many just consider it unethical as you broke a clause of your terms of employment.

What can an employee do?
- Employees shouldn't work for multiple companies as full-time employees.
- Work for secondary jobs as a freelancer. Do not obtain any additional benefits from them apart from your remuneration.
- Inform your primary employer about this.

What should companies do?
- Generations changed. Work mode has changed. This is 2022. Don't act so orthodox.
- If you are forcing employees to work more than 9 hours, accept the fact that they may work for someone else for some more hours.
- Offer a good package.

What should lawmakers do?
Make a strict law on
- working hours for primary companies; overtime should be highly paid.
- an employee should be answerable to their employer during these hours only.
- an employee should refrain from work that may cause conflicts.

Some trivia
A few of Infosys' founders were employees of PCS when they started Infosys. That was also moonlighting. But today, the same Infosys is against it.
