Santhal Pargana Tenancy Act,
Chotanagpur Tenancy Act.
Both were written by the British after 2 rebellions 1st in 1855 and the 2nd in 1908 after the rebellion led by Birsa Munda.
Birsa Munda died at 25 but British conceded the protection to the Adivasis he was fighting for. 2/19
These Laws protected Adivasis Alienation from their land.
In 2016 BJP Govt made amendments to these 2 laws. A fifth of all land in the state had already been acquired for mining, dams displacing 40 lakh Adivasis.
The then BJP CM of Jharkhand was Raghubar Das, Non-Tribal. 3/19
Changes in Laws would enable the Govt to acquire land for non-agricultural use. The ordinances were opposed by Father Stan.
He pointed out 'The extension of the listed use & intended purposes in subsection 49(1)(C) are clearly for real estate ... under private or PPP model. 4/19
Jharkhand CM R Das at an investment meeting in Mumbai mentioned changes in law would make available 71000 hectares (175000 acres) to industry.
At a 'Make in India' event earlier in the yr he signed agreements with industrialists, Adani Group alone 50000 crore in it. 5/19
Father Stan studied & inspected the land, verified the Ac nos & plot nos of the areas included in the land & travelled to villages to tell people that their land had been included in the land bank.
He was also part in protests across the State since 2015 the Bill placed. 6/19
Aug 2016 National Commission for Schedule Tribes said the amendments violated 2 Central Laws including PESA Act passed in 1996.
Swamy played an imp role in the campaign to implement the law at the ground level along with spreading awareness about PESA that time in 90s also. 7/19
However the State ignored & the Adivasis rebelled. On 22 Oct Police fired 11 rounds to a Tribal crowd killing one elderly Abhram Mundu.
It was the 3rd time the police fired bullets at the Tribal crowd in 3 wks.
It was clear that State Govt was not going to change the Laws. 8/19
Tribal activist Dayamani Barla said “In less than 2 yrs, the Modi-Raghuvar Das Govt has enabled police terror in Jharkhand."
In Jan 2017 shoes were thrown at CM Das by Adivasis protesting against the Laws in a program.
There were massive arrests of Tribals acrss the state.9/19
In July 2017 after sustained protests the then Governor of Jhar Smt Draupadi Murmu returned the laws with questions cited 192 protest petitions she had received, asking how the changes would help the people.
In between Tribals began to assert their rights more openly. 10/19
The Adivasis erected stone monoliths, named pathals outside their villages. Slowly more Adivasi villages started erecting these pathals, the movement named 'Pathalgadi' (The erecting of Pathals).
By Sept 2016 around 200 villages erected such Pathals. Arrests continued. 11/19
Aug 2017 a Police officer was seen as an intruder & not allowed to leave a village.
"Why should we allow outsiders to enter our villages...the Police come & Brand us Naxals & beat us up for no reason."( The Hindu, 14 April 2018).
In 2018 the movement faced more trouble. 12/19
In 2018 BJP MP Keria Munda's 3 security held by Patalgadi protesters demanding their people arrested to be released in exchange.
The BJP Govt responded by mass FIRs against the tribals. In just one Dist Khunti where Birsa Munda belonged the admin booked 11400 individuals. 13/19
Jharkhand Janadhikar Mahasabha a social movement network sent a fact finding team of Activists, academics & lawyers to Khunti. They found the severe repression & violence on the Adivasis by the state.
More than 10000 filed with sedition between July, 2017- July, 2018. 14/19
Adivasis in some villages were severely beaten, houses raided, ransacked. In Ghaghra Vill a pregnant Ashrita Munda delivered a physically disabled baby, a couple of wks after being beaten by the Police during the raid.
Media kept linking this protest to Anti-nationals. 15/19
The team also found police has also forcefully set up camps in schools and community buildings without the consent of gram sabhas in many Adivasi villages.
Father Stan in 2017 with other activists already sued the Govt on the arrests of Adivasis fighting for them legally. 16/19
In response the Jharkhand Govt charged Father Stan with Sedition.
However, in 2019 State Elec Adivasis became the factor defeating BJP.
After Hemant Soren won & became the CM 1st decision of the cabinet was to drop cases of Sedition, a year later 2/3 had been withdrawn. 17/19
Patalgadi was the victory of civil rights against the oppressor.
Father Stan continued his support, never seeking public limelight.
Dayamani Barla wrote
"Even in the programs, he would sit towards the end of the hall with common participants rather than with the leaders."18/19
Father Stan had conditioned himself to eat half a meal, as other tribal families around him did, 50 yrs of maintaining this habit made his stomach shrink.
Tribals wrote Father Stan's name in A stone slab dedicated to tribal martyrs at Bagaicha in Ranchi after his death.💙 19/19
After Father Stan was booked with Sedition Charge by the Jharkhand Govt in 2018 he wrote a short note asking 8 questions. He ended the note with
"These are the questions that I have consistently raised. If this makes me a ‘deshdrohi’ then so be it !"
