🧵Who is a Protem Speaker?
Under the provisions of Article 95(1) of the Constitution, President Droupadi Murmu has appointed Bhartruhari Mahtab as the Protem Speaker of the Lok Sabha.
But what is his role? 👇
‘Pro-tem’ - Temporarily
"Protem Speaker" refers to a temporary speaker appointed to preside over the first meeting of a newly elected legislative assembly or parliament until a permanent speaker is elected.
Note: The Constitution does not mention the post - "protem Speaker".
Article 95(1) states-
(1) While the office of Speaker is vacant;
the duties of the office shall be performed
- by the Deputy Speaker or,
if the office of Deputy Speaker is also vacant;
- by such member of the House of the People as the President may appoint for the purpose.
The concept of a Protem Speaker is not explicitly mentioned in the Indian Constitution, but it is a well-established parliamentary practice derived from the Constitution's provisions and parliamentary conventions.
Key Functions and Responsibilities?
• Administering Oath of office to the newly elected members of the legislative assembly or parliament
• Conducting the Election of the Speaker
• Maintaining Order and decorum in the House
• Limited Tenure
Significance:
• Ensuring Smooth Transition from one legislative assembly to the next (administering oaths, election of the Speaker).
• Upholding Parliamentary Traditions and procedures of the parliamentary system.
Appointment?
• Selection Criteria
- Usually the senior-most member of the House.
- Often chosen based on their experience and knowledge of parliamentary procedures.
• Appointment Authority:
- The President of India (Lok Sabha)
- Governor (State Legislative Assemblies)
Therefore, a Protem Speaker is crucial during the initial phase of a newly elected legislative assembly or parliament.
In the 17th Lok Sabha (2019), Virendra Kumar was appointed as the Protem Speaker. He administered the oath to the newly elected members and conducted the election of the Speaker.
