INTERESTING TIMES AHEAD!
Raul Vinci has finally taken SOME responsibility & became LoP.
BUT FOR HOW LONG?
I don't mean that he will quit as he can't now go on secret foreign tours or he won't be able to go frequently to Thailand for relaxation.
Something is up!

Raul Vinci is LoP, but what if he loses his MP post?
Why will that happen? Multiple reasons!

Basis is his British Citizenship. I think, many of you already know on this. But let me remind you details.

Raul was a director in M/s BACKOPS LIMITED bearing Company Number 04874597 from 21/08/2003 to 17/02/2009 & has declared in his submission that he's a British citizen.
His 2004 affidavit to ECI mentions his Directorship of BACKOPS & he holding several bank accounts in UK.

Article 84a prescribes, that " A person shall not be qualified to be chosen to fill a seat in Parliament unless he is a citizen of India".
Raul is a Citizen of "INDIA", but he has declared to be Citizen of UK also.
And BHARAT doesn't allow dual nationality.
Screwed!

You may ask why wasn't this matter raised before? It was & still pending before a Parliamentary Committee. But you know, BJP likes to play "Good Boy" & therefore, decision is deferred till date.
But now, matter is Subjudice & in Court. So, Raul may lose his position as MP.

πŸ”₯Also, Raul has been convicted by a Surat court & was sentenced to 2 yrs. His sentence has been suspended but case has not been decided.
Similar case had happened in 2001 too. A case was filed against Jayalalitha wherein her appointment as CM of TamilNadu was questioned.

Courts agreed with petitioner & Jayalalitha had to step down.
She was convicted u/s 13 of Prevention of Corruption Act, 1988 & sentenced for 3 years which clearly disqualified her under Article 191 and Section 8(3) of the Representation of the People Act, 1951.

Her sentence was suspended by the HC, however, the final judgment was still pending and so ECI didn't allow her to contest elections.
Raul was disqualified under Section 8 of the Representation of Peoples Act, 1951 (RPA) read along with Article 102 (1)(e).

The case has not yet been decided.
If so....going by HC judgement in the B R Kapoor vs State of Tamil Nadu case ( the abovementioned Jayalalitha case), the ECI shouldn't have allowed him to contest the elections in the first place.
But ECI did!

The ECI has clearly erred in allowing Raul to contest the election.
Rather, I will say ECI has not erred, but has deliberately overlooked the facts....just as ECI officials accepted affidavit by Amethi Candidate KL Sharma who mentioned 17th Lok Sabha instead of 18th.

There are widespread reports of ECI Officials allegedly working hand in glove with CONgress. Anyway, truth will come out in those allegations too.
Coming back to Raul, The petitioner has also asked the court to stay the oath of RaGa as an MP till the case is decided.

Vacation bench of Prayagraj HC has adjourned case & now it will be heard by regular bench.
But one things for sure that arguments of the petitioner are on sound basis & lawyers defending Raul will have a tough job.
As of now, based on Rules, Documents & Past Verdicts....it looks almost impossible for Raul to get himself off the hook.
And Raul is not even in position to impose "Emergency" to save his seat as his grandmother....Indira had done!
